Second Charge Against Texas Comic Retailer Dismissed

In the case of the Dallas, Texas comic book store manager charged with selling obscene material by selling copies of the Urotsukidoji: Legend of the Overfiend and Demon Beast Invasion: The Fallen comics, the Comic Book Legal Defense Fund was successfully able to overturn a guilty verdict for one of the two charges. After stating their intention to challange the second charge, the Dallas prosecutors office dropped the charge. The comic book store owner was charged with selling obscene material, yet the prosecution provided no expert testimony to prove that the comics in question were legally “obscene.” In light of that eventuality, and with the strong support of numerous expert witnesses, the Comic Book Legal Defense Fund successfully argued the unconstitunality and illegality of the first conviction. Having no legal basis to persue the second charge, the Dallas prosecutor’s office dropped the remaining charge of criminal activity.
