Also, you can get away with a lot just by calling it a parody. If you couldn't, the Wayan brothers wouldn't have a career.
Yeah . . . well sometimes it doesn't always works you know, which is why we do still see cases of 'Parody' claims go to court

Brand Management. If a company has invested enough in the brand, they want to control the use of that brand. Letting someone make a live-action fan adaptation of the original material now dilutes the property and decreases the potential market value of an adaptation later on.
That might be true, Leader Desslock. However, has there been a case where a company loss its potential value because of a fan's live-action-adaption-non-profit project?

They could have license to distribute an existing work without having license to make an adaptation. They might not even want license to make an adaptation. It all depends on their incentives. If they plan to make their own live adaptation, they might see this as diluting its value. If they can't do that or don't plan to, the financial incentive to pursue the matter is far less. Often, companies ignore not for profit fan works because pursuing them just isn't worth the money and potential negative PR and fan backlash. It's all downside for them and no upside.
I think old hat has got something there. But again, try to sell it or try to make a buck out a fan's live-action project and you'd better look out.

(Hmmm...maybe the Kaos Smilie is too cute for that. Maybe this one is better:
)

About fansubs - it helped bring, create, and maybe forced opened a new market for anime around the world. That's all right. But once anime companies and American license distributors finally built that market, then fansubs later became a liability that decreased the potential market value of anime in the market.

The nature of fansubs and fansub distribution has also changed radically since the early days when it required expensive equipment and involved actual duping and distribution of physical tapes.
